Terms and conditions of use and sale

LeadMax is online software (SaaS) to find local businesses that don't have a website, build them a website with the help of artificial intelligence, reach out to them and sell them that website.

The service is published and operated by Loomens technologies (لومانس تكنولوجيا), Société à Responsabilité Limitée (SARL, limited liability company), registered office at Marina Manzel Djerba, 4180 Houmet Essouk, Médenine, Tunisie, RNE / Identifiant unique (matricule fiscal): 1962151Y (see the legal notice).

LeadMax is a product owned and operated by Loomens technologies SARL. The LeadMax brand name is owned by Motez Hadj Salem. The product was created in collaboration between Loomens technologies and Motez Hadj Salem.

The Terms and the privacy policy are linked from the footer of every public page, from the sign-up page and from the plan page, before any payment.

Creating an account requires ticking the box "I accept the terms and conditions and the privacy policy". We keep the accepted version and the date of acceptance.

Any plan request or payment means you accept the Terms in force on that date.

• You can create an account with GitHub, Cloudflare or an email address and password.
• You must be of legal age, able to enter into a contract and provide accurate information.
• You are responsible for keeping your access details confidential and for all activity on your account.
• There is no free account: a new account starts with 0 credits.

LeadMax works with credit packs bought once. There is no subscription and no automatic renewal. Prices are in Tunisian dinars (TND):

• There are two separate wallets that never mix: lead credits (finding businesses) and AI credits (building and changing websites).
• The price that applies is the one shown when you send your request, after any valid discount code.
• Credits have no cash value: they can't be converted into money or transferred to another account.

• Every paid action shows its cost and asks for your confirmation before it starts.
• A search reserves its maximum cost up front, charges only accepted businesses and releases the rest at the end.
• Businesses that already have a website are filtered out and never charged.
• Credits are used when the action is carried out. If an action fails without a result, the credits reserved for it are released automatically.

Accepted payment methods:

• Bank transfer: after choosing a pack, you send a request from your account. Our bank details (RIB) and the reference to use are given to you in your account or by email.
• Online card payment through a licensed Tunisian payment provider, when this method is available. Your card details are entered on the provider's secure page: LeadMax never receives or stores them.

All payments are made in Tunisian dinars (TND).

LeadMax is a digital service: there is no physical delivery.

• Credits are added to your account once the payment is confirmed.
• Bank transfer: after we check the transfer, usually within 24 to 48 business hours.
• Online payment: immediately after the provider accepts the payment.
• The app tells you as soon as the credits are available. If they aren't within these times, contact us.

By asking for the credits to be added as soon as the payment is confirmed, you agree that the service starts immediately.

• There is no subscription to cancel: you can stop using LeadMax at any time and ask for your account to be deleted from your account settings or by contacting us.
• A plan request that hasn't been paid yet can be cancelled freely, from your account or by contacting us.
• Once the payment is made and the credits are added to your account, the purchase can no longer be cancelled or refunded.
• A running search can be stopped at any time: reserved credits that weren't used are released.

Purchased credit packs are final: they are non-refundable and non-exchangeable, and no return is possible, because this is a digital service consumed on use.

• Unused credits are not refunded, including when an account is deleted.
• A pack can't be exchanged for another pack, an AI top-up or money.
• If there is a payment mistake (for example the same transfer received twice, or credits not added), contact us at loomens.dev@gmail.com: we check and put it right.

The user who uses the platform takes full responsibility for how they use it. LeadMax and Loomens technologies only provide tools and are not a party to the user's sales or contracts. The user alone is responsible in particular for:

• their outreach to businesses (WhatsApp, email, calls, visits) and how often they reach out;
• the websites they create, publish and sell, their content, the photos and reviews used on them and the claims they make;
• their dealings and contracts with their own clients: prices, delivery, after-sales service, invoicing and taxes;
• complying with applicable law, including Tunisian Organic Law No. 2004-63 of 27 July 2004 on the protection of personal data for the businesses and people they contact, and anti-spam rules: introduce themselves clearly, respect a refusal and never harass;
• the Cloudflare, GitHub and Filebase accounts they connect and the websites published on those accounts.

The user indemnifies Loomens technologies against any third-party claim related to their use of the service.

It is forbidden to:

• send abusive, misleading or repeated messages to businesses that said no;
• publish a website in a business's name without its agreement, or pretend to be that business;
• create or publish illegal or defamatory content, or content that infringes third-party rights;
• get around the service's limits, resell or share access to an account, or automate its use abusively;
• try to access other members' data or disrupt the platform.

If these rules are broken, we may suspend or close the account, without refunding credits.

• Business information comes from public Google Maps listings collected through Apify. It may be incomplete or inaccurate.
• Content generated by artificial intelligence may contain mistakes: check it before publishing it or showing it to a client.
• The service relies on third-party providers (Cloudflare, GitHub, Filebase, OpenRouter, Apify, payment provider). We do our best to keep it available, without guaranteeing uninterrupted availability.

The LeadMax platform, its software and interfaces belong to their owners (Loomens technologies for the product, Motez Hadj Salem for the LeadMax brand). You receive a personal, non-exclusive right to use it while your account is open.

You may use, change, publish and hand over to your clients the websites generated with your credits. You remain responsible for the content you provide and for third-party rights in the texts, photos and reviews used.

LeadMax runs an affiliate program (also called the creator program). It is optional: any member can join from their Affiliate page after accepting this section. The rates, delays and amounts in force are shown on the program page and on the Affiliate page. They can change for the future; what is already earned keeps its terms.

• Link, code and page. Each affiliate gets a code, links and, if they wish, a public page in their name. A sign-up counts for them when the person creates their account within the delay shown after opening their link or their page, or types their code. An account has only one referrer.
• Benefit for the referred person. They may get a discount or bonus credits on their first pack. Unless stated otherwise at the time of purchase, this benefit is not combined with a promo code: only one of the two applies, as shown before the request.
• Commission. A commission is due only when a real payment of a referred person is approved by our team. It is computed on the amount really paid, after discounts and excluding TVA. Free or gifted credits earn no commission.
• Hold and reversal. A commission stays pending for the delay shown, then becomes available. It is reversed if the payment is cancelled, refunded or rejected. If it was already paid out, its amount is deducted from the next commissions.
• Payout. The available balance can be withdrawn by bank transfer to the affiliate's own account from the minimum shown, or used to buy LeadMax packs. Payouts are handled by our team. The affiliate alone is responsible for their tax and social obligations on the sums received.
• Rules of conduct. It is forbidden to refer yourself, to create fake accounts, to send unsolicited messages, to buy advertising on the LeadMax name, to present yourself as LeadMax or its team, or to promise earnings or results in a misleading way. The affiliate tells their audience clearly that they may earn a commission.
• Creator page. The affiliate is responsible for what they publish on their page (name, photo, texts, video, links). We can unpublish it if it breaks these rules. Any visitor can report it.
• Checks. Sign-ups that seem to come from the affiliate's own device or network are held and checked. In case of fraud or of a breach of these rules, we can void referrals and commissions, and suspend or exclude the affiliate.
• End of the program. We can change or stop the program. Commissions available on that date remain due.

The affiliate acts in their own name: they are not an employee, an agent or a representative of Loomens technologies.

To the extent permitted by law, Loomens technologies does not guarantee any business result and is not liable for indirect damage (lost revenue, clients or data), for disputes between the user and their clients, or for outages of third-party services. Its total liability is limited to the amount the user paid in the last 12 months.

How we handle your data is described in the privacy policy.

We may change the Terms. The date of the last update is shown at the top of this page. If the change is significant, the new version is shown to you and must be accepted before you keep using the service. If you refuse it, you can stop using the service and ask for your account to be deleted.

The Terms are governed by Tunisian law.

• If you have a complaint or a dispute, first contact us at loomens.dev@gmail.com or +216 29 183 841 and describe your request: we look for an amicable solution within 30 days.
• If no amicable solution is found within that time, the dispute is brought before the competent Tunisian courts with jurisdiction over the registered office (Médenine).
